Prosecutorial discretion to apply sentencing reduction limits in guilty plea procedures during the investigation phase
Legislator summary
AI generatedThe High Court of Cassation and Justice, acting through the panel for resolving legal questions in criminal matters, ruled that the prosecutor may not apply the provisions of Article 396(10) of the Code of Criminal Procedure during the plea bargain procedure in the investigative phase, as this application would directly reduce the statutory sentencing limits for the committed offense. The case arose from a request for a preliminary ruling by the Court of Appeal of Galați regarding the legality of the prosecutor's power to retain a specific procedural provision that affects the scope of potential penalties when a defendant admits guilt. Based on the legal framework for resolving legal questions (Articles 480–485 of the Code of Criminal Procedure), the court established that such an interpretation is impermissible, thereby clarifying the limits of prosecutorial discretion in modifying sentencing constraints within the guilty plea mechanism.
