Eligibility for political persecution benefits under Decree-Law 118/1990: scope of "mandatory residence" and inclusion of socially incompatible classes
Legislator summary
AI generatedThe High Court of Cassation and Justice, sitting as the panel for resolving issues of law, admitted a reference from the Bucharest County Court and issued a binding interpretation regarding the eligibility for benefits under Decree-Law No. 118/1990, ruling that the decree applies to persons belonging to social classes deemed incompatible with the post-March 6, 1945 social order, provided they prove persecution under the specific categories listed in Article 1(1)(a)–(e), and clarified that mandatory residence requires an administrative measure restricting the right to freely choose a domicile, not merely limited freedom of circulation, thereby allowing family members who lived with the designated person to also qualify for benefits. The dispute concerned the scope of political persecution rights under the 1990 Decree-Law, specifically whether chiaburs and family members of those subject to administrative residence measures were entitled to reparations, with the decisive legal basis being the judicial construction of Article 1(1) and Article 1(1)(d) of Decree-Law No. 118/1990 to exclude mere circulation limits from the definition of mandatory residence while including socially incompatible classes as potential beneficiaries if they meet the substantive persecution criteria.
