The High Court of Cassation and Justice resolved a referral from the Craiova Court of Appeal, establishing as a binding interpretation that a judicial technical expert is classified as a civil servant under Article 175, paragraph (2), first sentence, of the Penal Code, rather than under paragraph (1). The dispute arose from a need to clarify the status of judicial technical experts for the purpose of applying criminal provisions related to public officials. By determining the specific sub-paragraph governing this category, the Court provided a definitive legal standard for future cases involving the criminal liability or status of such experts, with the decision becoming mandatory upon publication in the Official Gazette.
