The High Court of Cassation and Justice, acting as the full panel for resolving legal issues in criminal matters, admitted the referral from the Târgu Mureş Court of Appeal and issued a binding precedent stating that the more favorable criminal law must be applied to offenses committed before February 1, 2014, that have not yet been definitively adjudicated. This decision resolved a conflict between prior judicial interpretations regarding the statute of limitations, clarifying that the new favorable regime takes precedence over the expired prescription periods established under the previous interpretation. The ruling is grounded in Article 5, Paragraph 1 of the Penal Code, which mandates the application of the more favorable criminal law, and aligns with Decision No. 265/2014 of the Constitutional Court, thereby establishing that the extended limitation periods under the new code apply even where the old prescription period would have already expired.
