The High Court of Cassation and Justice rejected as inadmissible the referral from the Court of Appeal of Iași seeking a preliminary ruling on the interpretation and application of Articles 4, 5, 6, 7, 8, 9, 11, 12, 14, 16, 17, 20, 21, 22, 24, 25, 27, 31, 33, and 35 of Law No. 165/2013, as amended, in relation to Laws No. 10/2001 and No. 247/2005 regarding restitution of property in cases pending before courts. The referral was dismissed as inadmissible, meaning the lower court's request for a preliminary ruling was not accepted on procedural grounds. The dispute involved a request for clarification on how the 2013 restitution framework law interacts with earlier restitution laws in pending cases. The decisive legal basis was the procedural inadmissibility of the referral under the rules governing preliminary rulings, specifically failing to meet the admissibility criteria for such referrals, with the decision rendered binding pursuant to Article 521(3) of the Civil Procedure Code (Law No. 134/2010).
