Admissibility of independent claims for degree issuance and ministry approval separated from program accreditation status
Legislator summary
AI generatedThe High Court of Cassation and Justice dismissed as inadmissible the preliminary ruling request submitted by the Ploiesti Court of Appeal, meaning the lower court must resolve the matter without the Supreme Court's guidance. The dispute centered on whether a former student’s claims for the issuance of a bachelor's degree and for the Ministry of National Education to approve standardized diploma forms could be litigated independently of the accreditation status of the specific study program, and whether a university's request to call the Ministry into guarantee was permissible under civil procedure law regarding non-monetary obligations. The Court determined the request was inadmissible based on the procedural provisions of Article 521(3) of the Code of Civil Procedure, leaving the questions regarding the interpretation of Law No. 75/2005 (regarding accreditation and diploma issuance) and the admissibility of guarantee proceedings under Article 72 of the Code of Civil Procedure for the lower courts to decide.
