The High Court of Cassation and Justice (Înalta Curte de Casaţie şi Justiţie) admitted the referral from the Suceava Court of Appeal and, in a preliminary ruling for the resolution of a question of law, held that Article 34 of Framework Law No. 284/2010 on the unitary remuneration of personnel paid from public funds does not apply to the salary rights of personnel employed under financing contracts concluded before that law entered into force. The ruling, which is binding under Article 521(3) of the Civil Procedure Code, was made in a civil case concerning salary adjustments challenged after the 2010 law came into effect, and it resolves the interpretive question by limiting the law's retroactive application to pre-existing contractual salary entitlements, thereby prevailing in favor of the employees whose rights predate the law.
