The High Court of Cassation and Justice admitted the referral from the Harghita Tribunal and issued a preliminary ruling for the uniform interpretation of law, holding that Article 6(1) of the Romanian Criminal Code—concerning the application of the more favorable criminal law after a final conviction—also applies to a conviction pronounced by another state against Romanian citizens, provided that conviction has been recognized under the procedure set out in Law No. 302/2004 on international judicial cooperation in criminal matters. The court thereby resolved the legal question in favor of applying the more favorable law to such recognized foreign convictions for Romanian citizens serving the sentence in Romania. The ruling is binding from its publication in the Official Gazette of Romania, pursuant to Article 477(3) of the Code of Criminal Procedure.
