Continuity of illicit influence and influence peddling offenses under the new Penal Code: Decriminalization question resolved by affirming inclusion in new Article 367
Legislator summary
AI generatedThe High Court of Cassation and Justice admitted the reference for the resolution of a legal question and ruled that the crimes of illicit influence and influence peddling under the 1968 Penal Code and the pre-2012/2013 version of Law No. 39/2003 were not decriminalized but instead correspond to the offense under Article 367(1) of the 2009 Penal Code. The case involved a dispute initiated by a Court of Appeal regarding whether specific historical incriminations persisted in the new criminal code or were implicitly repealed, necessitating a final determination for uniform application. The decisive legal basis relied on the comparative interpretation of Article 323 of the former Penal Code, Article 8 of Law No. 39/2003 (as it existed before amendments by Laws No. 187/2012 and 255/2013), and Article 367(1) of the 2009 Penal Code, establishing that the legislature intended to preserve these offenses within the new incrimination framework rather than removing them.
