Binding interpretation: Exclusion of mandatory penalty increases for continued offenses from statutory maximum under more favorable criminal law
Legislator summary
AI generatedThe High Court of Cassation and Justice, acting through the panel for resolving issues of law in criminal matters, issued a binding preliminary decision that established the interpretation of "special maximum penalty" under the principle of the more favorable criminal law (Article 6 of the Penal Code). The dispute arose from referrals by two appellate courts regarding whether, for continued offenses (*infracţiuni continuate*), the statutory maximum under the new law includes the mandatory penalty increase applicable to such forms of legal unity of offenses. The Court ruled that the "special maximum provided by the new law for the committed offense" refers strictly to the base statutory maximum for the offense itself, excluding the additional penalty increment prescribed for the continued nature of the crime, thereby limiting the scope of the favorable retroactivity calculation. This decision, based on Article 477(3) of the Code of Criminal Procedure, is obligatory for the courts that referred the matter and for other courts facing similar issues.
