Application of more favorable criminal law to criminal attempt: maximum penalty limit based on attempted form rather than consummated offense
Legislator summary
AI generatedThe Supreme Court of Cassation and Justice, sitting as the complete body for resolving legal questions in criminal matters, admitted the referral from the Bucharest Court of Appeal and issued a mandatory binding interpretation regarding the application of more favorable criminal law. The dispute concerned the procedural mechanism for applying a more lenient statute post-conviction specifically in cases of criminal attempt, where the challenge was determining whether the statutory maximum penalty limit should be calculated based on the consummated offense or the attempted form. The court ruled that under Article 6, Paragraph 1 of the Criminal Code, when applying the more favorable law after final judgment in an attempt scenario, the maximum penalty limit to be considered is the special maximum provided for the attempted form (i.e., the maximum for the consummated offense reduced or substituted per the sanctioning rules for attempt), not the full maximum for the completed crime.
