The High Court of Cassation and Justice, ruling on a preliminary question referred by the Bucharest Court of Appeal, admitted the referral and held that the provisions of Article 22(4)(b) of Law No. 187/2012, implementing the new Criminal Code (with reference to Article 129(2)(b) of that Code), are not applicable to offenses finally decided as of 1 February 2014. The ruling, binding under Article 477(3) of the Criminal Procedure Code, resolves a interpretative conflict over whether the transitional law on the recalculation of the maximum penalty for multiple offenses could be applied retroactively to already-final judgments. The Court reasoned that the transitional provision could not alter final judgments, thereby prevailing the principle of res judicata and the non-retroactivity of criminal law as applied to settled cases.
