The High Court of Cassation and Justice admitted the referral filed by the Bucharest Court of Appeal and established that criminal liability statute of limitations is an autonomous legal institution distinct from the penalty institution. The dispute concerned the interpretation of the principle of applying the more favorable criminal law, specifically whether changes to the statute of limitations could be applied retroactively to cases pending at the time the new law was in force. Relying on Article 5 of the Penal Code, the court ruled that the statute of limitations operates independently of the penalty, a decision that became mandatory upon its publication in the Official Gazette in accordance with Article 477(3) of the Code of Criminal Procedure.
