The High Court of Cassation and Justice dismissed as inadmissible the request for a preliminary ruling filed by the Specialized Cluj Court regarding Case No. 18785/211/2013. The dispute concerned the interpretation of Article 120 of Emergency Government Ordinance No. 99/2006 on credit institutions and capital adequacy, read in conjunction with Article 22 of Law No. 136/1995 on insurance, specifically addressing whether a request for approval of forced execution of a credit contract is valid when submitted by an insurer subrogated in the rights of the creditor bank. The court applied Article 521(3) of the Code of Civil Procedure to find the referral inadmissible, leaving the lower court's proceedings to continue without a binding legal clarification from the supreme judiciary.
