The High Court of Cassation and Justice dismissed as inadmissible the request for a preliminary ruling filed by the Specialized Cluj Tribunal, meaning no binding interpretation was issued and the original proceedings remain unresolved by this specific court. The dispute concerned the interpretation and application of Article 120 of Emergency Government Ordinance No. 99/2006 regarding credit institutions and capital adequacy, in conjunction with Article 1396 of the 1864 Civil Code, specifically within the context of a request for judicial authorization of forced execution of a credit contract where the creditor was the assignee of the claim. The court's decision relied on the procedural requirements set forth in Article 521(3) of the Civil Procedure Code adopted by Law No. 134/2010 to determine the inadmissibility of the submission.
