The High Court of Cassation and Justice allowed the appeal filed by the social insurance institution, quashed the appellate court's judgment, and remanded the case to the Bucharest District Court, thereby ruling that the appellate court lacked subject-matter jurisdiction. The dispute concerned a lawyer's challenge to the refusal to pay a child-raising allowance for a minor, with the institution arguing that such litigations must be handled by district courts rather than appellate courts acting in the first instance. Relying on Article 134 of the Statute of the Social Insurance House for Lawyers, which aligns the lawyers' social insurance system with the public system, and Article 156 of Law No. 19/2000, which expressly assigns jurisdiction over disputes regarding social insurance rights and unjustified refusals to resolve requests to the district courts, the supreme court established that only the tribunal (district court) is materially competent to adjudicate such claims.

art.156 din Legea nr.19/2000

Main ground for the verdict, establishing that district courts (tribunals) have exclusive subject-matter jurisdiction over disputes concerning social insurance rights, thus justifying the quashing of the appellate decision for lack of competence.
