The High Court of Cassation and Justice dismissed as unfounded the criminal appeal filed by the convicted defendant, thereby upholding the appellate decision that had previously rejected the defendant's motion for revision of the final criminal sentence. The dispute centered on the defendant's attempt to obtain a revision of a definitive criminal judgment based on the reduction of the imposed penalty and the health conditions of family members, which were not recognized as valid grounds for revision. Relying on Article 394 of the Code of Criminal Procedure, the court held that revision is limited to specific cases expressly provided by law and that the mere reduction of a penalty or personal health circumstances do not constitute statutory grounds for revising a final judgment; consequently, the lower courts' refusal to grant the revision was affirmed, and the defendant was ordered to pay judicial costs to the state, with a portion advanced from the Ministry of Justice for official defense.
