The High Court of Cassation and Justice rejected the defendant's appeal in cassation, thereby upholding the prior convictions for robbery (tâlhărie) from both the first and second instances. The dispute centered on whether the act of snatching a mobile phone from the victim's hand constituted violent taking under the penal code or merely a theft without violence; the material facts established that the defendant ran up from behind and forcibly tore the phone from the victim's grasp. The Court held that this action constitutes a violent mode of appropriation by using force to break the victim's physical contact with the property, which satisfies the elements of robbery under Article 211, paragraphs 1, items (d) and (e) of the Penal Code, rather than simple theft.
