Pre-trial detention upheld despite suspension of trial pending constitutional review
Legislator summary
AI generatedThe court (High Court of Cassation and Justice, criminal section) dismissed the defendants' appeals and upheld the lower court's order maintaining their pre-trial detention, so the detention order remains in force. The dispute arose when the lower court, while suspending the criminal trial pending the Constitutional Court's ruling on a constitutionality exception raised by the defendants against Articles 300² and 160b of the Criminal Procedure Code, also ruled to keep the defendants under preventive arrest. The defendants challenged only the legality of that detention maintenance, arguing that suspension of the trial should preclude it. The High Court held that, under Article 303(6) and Article 300² of the Criminal Procedure Code, suspending the trial does not affect preventive measures, and the court remains obliged to review the legality and merits of preventive detention under the conditions of Article 160b; therefore, the suspension does not vitiate the detention order, and the lower court correctly found that the legal and factual grounds for detention persisted.

C. proc. pen., art. 3002, art. 303 alin. (6)
I.C.C.J., secţia penală, decizia nr. 6358 din 31 octombrie 2006
160b alin. (3) raportat la art. 3002 C. proc. pen., s-a dispus menţinerea arestării preventive a inculpaţilor P.V. și C.A.
Prin aceeași încheiere, în baza art. 29 alin.
