The High Court of Cassation and Justice reversed the appellate court’s decision to annul the claimant's appeal for lack of judicial stamp, holding that the appeal was validly filed and the appeal court erred in applying the stamping requirement, thereby remanding the case for re-judgment on the merits. The dispute arose from a commercial lease where the claimant, a public authority entity, had recovered rent payments that were subsequently transferred to the state budget, while the original first-instance judgment had only partially admitted the lease claim and also ordered the claimant to pay damages for the defendant's losses. The court determined that because the recovered rental sums were deposited into the state budget and thus acquired the character of public revenue, the claimant was exempt from paying the judicial stamp tax under Article 17 of Law No. 146/1997, rendering the appellate court's procedural dismissal unlawful.
