The Supreme Court (Înalta Curte de Casaţie şi Justiţie) admitted the claimant’s appeal, reversed the appellate court’s decision, and upheld the trial court’s judgment, thereby restoring the order requiring the defendant to pay damages to the claimant. The dispute arose from a contract for rail transport of scrap metal to Italy, where the defendant had issued an inspection certificate stating the wagon was free of radioactivity; after the wagon was refused at the Italian border for containing radioactive material, the trial court held the defendant liable for superficial inspection. The appellate court had dismissed the claim, reasoning that since the wagon traveled uncovered, contamination could have occurred during transport, excluding the defendant’s fault. The Supreme Court, applying Article 314 of the Civil Procedure Code (allowing review on the merits only to correctly apply the law to fully established facts), found the appellate court erred: the radioactive metal piece was discovered only upon the wagon’s return, and the defendant’s certificate attested the wagon was radiation-free at departure, so the later discovery could not have arisen from transport. The defendant’s superficial inspection caused the claimant’s loss, and liability was correctly imposed by the trial court.

Recurs. Aplicarea art.314 C.proc.civ.
