The High Court of Cassation and Justice (Criminal Section) dismissed the convicted person’s appeal as unfounded, upholding the Military Court of Appeal’s decision No. 16 of 20 February 2003, which had rejected the appellant’s challenge against execution and maintained the lower court’s refusal to suspend the prison sentence; the appellant, convicted in 1995 to 8 years’ imprisonment for fatal assault (art. 183 Criminal Code), had been released on medical grounds in 1997 but was ordered re-incarcerated in 2002 and sought suspension again due to illness. The Court held, under arts. 455 and 453 lit. a) of the Criminal Procedure Code, that execution of imprisonment may be interrupted only where a forensic medical examination shows the convicted person suffers from a disease rendering them unable to endure detention; here, the National Institute of Forensic Medicine reported that the appellant’s illnesses could be treated within the prison health network, so the statutory condition for suspension was not met. The court also ordered the appellant to pay 400,000 lei in judicial costs to the state.

Asupra recursului de față;

Hotărârea a rămas definitivă.

Condamnatul a declarat apel, reiterând contestația.

38515 pct. 1 lit. b) C. proc. pen., decizia va fi menținută, prin respingerea recursului, conform dispozitivului deciziei.
