The High Court of Cassation and Justice dismissed the Attorney General's appeal for cancellation, upholding the Court of Appeal's decision to annul the enforcement measures and affirming the plaintiff's success. The dispute concerned the forcible execution of budgetary claims for rent and default surcharges under an agricultural land lease agreement between a private individual and a municipality, where the plaintiff challenged the enforcement forms initiated under the government ordinance on budgetary claims. Relying on the civil procedure requirement that execution applies only to certain, liquid, and exigible debts, the court held that because the debt stemmed from a lease contract governed by general civil law, its existence and amount required a judicial judgment rather than being directly enforceable under the specific provision for uncontested budgetary claims; consequently, the enforcement was proper only under the provision requiring a court judgment, validating the annulment of the enforcement acts.

Executare silită.Creanţe bugetare.Titlu executor.
