The High Court of Cassation and Justice resolved a negative competence conflict by ordering the case to be judged by the Zărnești Court, ruling that this court prevailed in the jurisdictional dispute against the Sector 1 Bucharest Court. The dispute concerned a main action for tabular rectification of a real estate title (restitution of a legal status prior to an illegal change) joined with an accessory request to annul an inheritance certificate issued in favor of a defendant. The Zărnești Court had initially declined competence in favor of the last domicile of the deceased under inheritance rules, while the Sector 1 Court referred the conflict to the Supreme Court arguing for the jurisdiction of the real estate location. The decisive legal basis was Article 17 of the Code of Civil Procedure, which mandates that accessory and incidental claims fall under the jurisdiction of the court competent to judge the principal claim, even if this overrides general or exclusive competence rules; because the main action was a real property action, it was subject to the exclusive and mandatory jurisdiction of the court where the property is located under Article 13(1), making the Zărnești Court the competent forum.
