The court admitted the appeal and, modifying the lower decision, reinstated the first-instance judgment, ordering the defendant to conclude the sale-purchase contract with the plaintiff-tenant under Law No. 112/1995, with the plaintiff prevailing. The dispute arose when the tenant sued the property-holding company for refusing to sell the leased dwelling, which had not been subject to restitution under Law No. 10/2001; the trial court ordered the sale, but the appellate court reversed, holding the tenant's right was only conditional until the owner decided to sell. On appeal, the High Court of Cassation and Justice ruled the appellate court misread Article 9 of Law No. 112/1995: the phrase "may sell" grants the tenant the option to buy, not the holder discretion to refuse, so the refusal was unlawful; consequently, the appeal was upheld, the appellate decision was reversed, and the defendant's appeal was dismissed as unfounded, leaving the original order to sell in force.

- Contract de vânzare-cumpărare (reglementat prin Legea nr. 112/1995)

Legea nr. 112/1995: art.9

Impotriva hotărârii primei instanţe pârâta a declarat apel.
