The High Court of Cassation and Justice dismissed as time-barred the criminal revision appeal filed by the convicted defendant against the Iaș Appeal Court’s decision to uphold the original conviction and maintain the lower court’s order for 300 RON in judicial costs; the revised decision in force is the appellate ruling, with the appellant now ordered to pay 200 RON in judicial costs to the state, including 100 RON for an ex officio attorney advanced by the Ministry of Justice. The dispute concerned the admissibility of a petition for revision of a final criminal judgment, specifically whether the appeal against the appellate court’s dismissal of the revision request was filed within the statutory deadline; the material facts establish that the judgment was served on the inmate on January 26, 2012, but the appeal was not filed until February 16, 2012. Relying on Article 3853 of the Code of Criminal Procedure, which sets a ten-day limit for filing appeals against decisions on revision, and Article 38515(1)(a) for the dismissal of late appeals, the Court determined that the deadline was violated, rendering the appeal inadmissible.
