The High Court of Cassation and Justice dismissed the petition for the transfer of jurisdiction as having become moot, a decision that is final and without avenue for appeal. The dispute concerned a request by a co-ownership association to transfer a civil case from the Bihor Tribunal to a different court; however, the underlying proceedings at the lower instance were concluded on September 4, 2012, prior to the hearing. The Court rejected the petitioner’s accompanying requests for a hearing postponement and noted that the prosecution formally requested the dismissal of the transfer petition. The decisive legal basis for the ruling was the procedural doctrine of "res judicata" regarding the object of the request: since the substantive case subject to the transfer application had already been adjudicated, the petition for jurisdictional transfer lacked a legal object and was therefore dismissed as remaining without object.
