Jurisdictional transfer denied due to prior resolution of the underlying case

The High Court of Cassation and Justice dismissed without appeal a motion filed by a party to transfer jurisdiction of a civil case from the Galați Court of Appeal to the High Court, ruling that the request was inadmissible. The dispute centered on a procedural application to move a case already recorded as resolved on April 30, 2012, pursuant to the court’s electronic docket system. The decisive legal basis was the procedural requirement that a case must be pending for a transfer request to be considered; consequently, the court held that because the underlying proceeding had already concluded prior to the filing of the motion, the legal prerequisites for a change of venue were not met, leaving the original resolution of the matter unaffected.
