Transfer of civil litigation jurisdiction between appellate courts due to procedural necessity

The High Court of Cassation and Justice granted the petition for change of venue, transferring the civil case from the Bucharest Court of Appeal to the Pitești Court of Appeal, a decision that is final and without appeal. The dispute involved a procedural request by a party to relocate the hearing of the underlying civil litigation (Case No. 3922/87/2011) from the originally competent appellate court to a different regional appellate court. The court based its decision on the legal finding that the service procedures for the request were lawfully executed and, following the report of the assistant magistrate and the public prosecutor’s admission, it ordered the transfer of jurisdiction while preserving all procedural acts previously compiled.
