Dismissal of request for transfer of jurisdiction from Toplița Court to Bucharest
Legislator summary
AI generatedThe High Court of Cassation and Justice dismissed the plaintiffs' request for the transfer of jurisdiction (strămutare) of Case No. 2634/96/2011 from the Toplița Court, resulting in a final, non-appealable decision that maintained the original court's competence. The dispute involved a procedural challenge where the plaintiffs, initiating a civil case regarding a real estate matter, sought to move the trial from Harghita County to Bucharest to secure local legal representation, while also filing a preliminary request to postpone the hearing; the Public Prosecutor opposed both motions. The Court denied the postponement as insufficiently motivated under Article 156(1) of the Civil Procedure Code, noting the plaintiffs had adequate time to prepare, and rejected the transfer request on the basis that the procedural requirements for jurisdictional transfer were not met, thereby upholding the jurisdiction of the local court.
