The High Court of Cassation and Justice (Civil Section I) rejected the applicant's motion to transfer the case (Dosar nr. 5943/327/2011) pending before the Tulcea Tribunal, ruling without appeal and thereby leaving the original proceedings in place. The applicant had sought the transfer under procedural rules governing case reassignment, likely alleging bias or legitimate suspicion, but the court noted the underlying case had already been resolved on 9 December 2011, and the Public Ministry opposed the motion. The decision rests on the finding that the motion became moot or lacked grounds once the case was decided, with the court exercising its discretion under the applicable provisions on case transfer (strămutare) in the Romanian Code of Civil Procedure.
