Mootness of jurisdictional transfer request following resolution of underlying civil case

The High Court of Cassation and Justice dismissed the request for transfer of jurisdiction, leaving no further appeal, as the application was declared moot. The dispute concerned a procedural motion by the plaintiffs to have the underlying civil case, initially docketed with the Cluj Court of First Instance, transferred to a different tribunal; however, during the hearing, the court noted via its electronic records that the substantive trial had already been decided and concluded on October 2, 2012, two days prior to this ruling. Relying on the principle that a cause of action ceases to exist once the underlying judgment is rendered, the court agreed with the Public Ministry's conclusion that the transfer request had lost its legal object, thereby extinguishing the procedural claim without addressing the merits of the original jurisdictional challenge.
