The High Court of Cassation and Justice (Criminal Section) denied as unfounded the applicant's motion to transfer the trial of a case pending before the Craiova Court of Appeal, and ordered the applicant to pay 100 RON in judicial costs to the state; the decision is final. The applicant sought the transfer under Article 57 of the former Romanian Code of Criminal Procedure, arguing that the impartiality of the judges could be compromised because the respondents included the chief prosecutor of the Prosecutor's Office attached to the Craiova Court of Appeal and a judge of that same court. The Court, after reviewing the case file and information from the Ministry of Justice, held that the circumstances, the parties' status, and the subject matter did not raise legitimate suspicions capable of undermining the judges' objectivity and impartiality or violating the right to a fair trial under Article 6 of the European Convention on Human Rights; although the applicant's grounds formally fell within the categories listed in Article 55 of the Code as amended by Law No. 356/2006, they were not serious enough to justify transfer, so the motion was rejected under Article 60(1) and costs were imposed under Article 192(2).

Drept urmare, conform art. 60 alin.
