The High Court of Cassation and Justice (Penal Section) issued a final and binding decision accepting the withdrawal of a criminal complaint, thereby ending the proceedings and ordering the complainant to pay 20 RON in judicial costs to the state. The case involved a pre-trial criminal complaint filed by a prisoner alleging that a prison doctor committed offenses under Articles 247 and 267 of the Penal Code by repeatedly refusing medical treatment; however, the complainant appeared in open session and declared that he did not intend to maintain the complaint and requested its withdrawal. Relying on the complainant's expression of will and finding that the complaint no longer met the substantive and formal requirements of Article 222 of the Code of Criminal Procedure, the Court formally took note of the withdrawal pursuant to Article 192 of the Code of Criminal Procedure.
