Late appeal held time-barred, lower court ruling and 500 RON costs award upheld.
Legislator summary
AI generatedThe High Court of Cassation and Justice dismissed as tardy the appeal filed by the petitioner against the Târgu Mureș Court of Appeal’s judgment of 29 March 2010, which had rejected her complaint against a prosecutor’s resolution, and ordered her to pay 500 RON in judicial costs to the state; the dismissal was on procedural grounds only, leaving the lower court’s decision in force. The underlying dispute involved the petitioner’s challenge to a criminal investigation resolution concerning an alleged offense, but the decisive issue was purely procedural: under Articles 385³ and 363 of the Romanian Criminal Procedure Code, the appeal deadline was 10 days from the judgment’s pronouncement for the party present at the hearings, and the petitioner filed her appeal on 12 April 2010, beyond the 10-day period that ran from 29 March 2010. Relying on Article 385¹⁵(1)(a) C. proc. pen., the court held the appeal was time-barred and therefore inadmissible on the merits.
