Withdrawal of case transfer request accepted; petitioner ordered to pay 100 lei costs.
Legislator summary
AI generatedThe High Court of Cassation and Justice took formal note of the withdrawal of the petitioner's request to transfer the case file (no. 49702/3/2010, pending before the Bucharest Tribunal, Second Criminal Section) and ordered the petitioner to pay 100 lei in judicial costs to the state; the decision is final. The petitioner had originally sought the transfer of the case, arguing that the judges' impartiality could be compromised given the circumstances and the parties' status, but later filed a written withdrawal because the challenge to the assigned judge (filed by a co-defendant) had been granted, eliminating the basis for the request. The court relied on the petitioner's expressed will and, pursuant to Article 192(2) of the Romanian Code of Criminal Procedure, dismissed the application as withdrawn, with the cost-shifting consequence.
