Untimely stamp duty omission and defective service of process in commercial cassation
Legislator summary
AI generatedThe High Court of Cassation and Justice dismissed as unfounded the cassation appeal filed by the defendant, thereby upholding the lower court's decision to annul the defendant's appeal as untimed and lacking the required stamp duty. The dispute concerned a commercial matter where the appellant challenged the procedural regularity of the previous instance's decision, arguing that the exact amount of the stamp duty had not been properly notified and that service of process was ineffective due to the appellant's absence. The Supreme Court rejected these claims, finding that the proof of service explicitly disclosed the due amount and that the appellant had appeared at the hearing without requesting a deadline for payment, thus accepting the court's assessment of the omission. The decision was rendered pursuant to Article 312 of the Civil Procedure Code, which governs the dismissal of unfounded cassation appeals, resulting in a final, irrevocable judgment that maintained the annulment of the prior appeal.

312 C. proc. civ.
PENTRU ACESTE MOTIVE
