Pension house’s appeal over ethnic persecution benefits rejected; annulment and backdated award upheld as timely filed.
Legislator summary
AI generatedThe High Court of Cassation and Justice dismissed the defendant pension house’s appeal as unfounded, thereby upholding the lower court’s judgment that had annulled the defendant’s decision of 23 July 2007 and ordered the defendant to recognize the claimant’s entitlement to benefits under Law No. 189/2000 for the period 1 April 1941 – 6 March 1945, effective from 1 April 2007. The dispute concerned the claimant’s application for benefits as a victim of ethnic persecution during World War II, which the defendant had rejected; the lower court had accepted the claim based on witness testimony and corroborating evidence of the claimant’s refuge with her mother from 1941 due to persecution by Hungarian occupying forces in Northern Transylvania after the Vienna Dictate. The sole ground of appeal was the alleged untimeliness of the original action under Article 7(4) of Law No. 189/2000, which sets a 30-day limit for challenging a pension house decision. The High Court rejected this argument, finding from the case record that the challenged decision was communicated on 10 August 2007 and the action was filed on 10 September 2007—within the statutory 30-day period—so no grounds for cassation or modification existed under Articles 304 and 304(1) of the Civil Procedure Codecourt issues). Thus, the lower court’s decision remains fully in force accordion.

Asupra recursului de față;
