Expropriation compensation appeal declared time-barred and communication of oral timeliness objection dispensable
Legislator summary
AI generatedThe High Court of Cassation and Justice dismissed the appeal filed by the expropriating authority (represented by the State), upholding the lower court's decision to reject the defendant's appeal as time-barred; consequently, the first-instance judgment ordering the payment of EUR 33,000 (in RON equivalent) and litigation costs to the claimant remains final and in force. The dispute arose from an expropriation case where the claimant sought payment for expropriated property and the cancellation of an expropriation order, while the appellant argued that the lower court violated procedural norms by failing to communicate the opposition to the timeliness of the appeal, thereby infringing the right of defense and the principle of contradiction. The Supreme Court held that the appeal was inadmissible because it was filed 14 April 2010, well after the 15-day statutory deadline calculated from the 22 March 2010 service of the first-instance judgment, under Article 301 of the Code of Civil Procedure; the Court further ruled that since the timeliness objection was raised orally by the claimant's counsel at the first hearing, formal communication to the absent defendant was not required, and the defendant's failure to appear to defend against the exception was a matter of their own procedural discretion under the principle of dispositiveness.

312 alin. (1) C. proc. civ.
