Peremption of appeal due to one-year inactivity in civil proceedings
Legislator summary
AI generatedThe High Court of Cassation and Justice confirmed the peremption of the appeal filed by the public domain administration, thereby upholding the finality of the Civil Court of Appeal's decision of December 22, 2000, as the appellant's appeal remained inactive for the statutory period. The dispute arose from a civil proceeding in which the appellant had appealed a lower court judgment, but no procedural steps were taken after the appeal was suspended in June 2002, resulting in a year-long state of inactivity attributable to the parties. The court applied Articles 242(2), 248, and 252 of the Civil Procedure Code, which provide for the automatic peremption of any claim or appeal that remains in abeyance for one year in civil matters due to the fault of the parties, and ordered the peremption to be noted ex officio or upon request.
