Nullity of appeal for failure to motivate grounds under Article 3021 of the Code of Civil Procedure
Legislator summary
AI generatedThe High Court of Cassation and Justice sustained the nullity of the appellant's appeal, thereby upholding the Court of Appeal's prior decision that declared the initial appeal null, and ordered that the appellant's current appeal is invalid. The dispute arose from a commercial and administrative fiscal matter where the appellant filed an appeal against a court of appeal judgment that had already quashed her previous appeal for lack of motivation. The appellate court re-examined the procedure ex officio, focusing on the procedural defect that the appellant failed to include the grounds for the appeal or a statement that they would be submitted separately, as required by law. The decisive legal basis was Articles 3021 and 306 of the Code of Civil Procedure, which mandate that an appeal must contain reasoned grounds for illegality under penalty of nullity, unless grounds of public order exist; since the appellant's filing contained no such motives and no public order issues were identified, the court ruled the appeal null pursuant to Article 312(1) of the Code of Civil Procedure.

Asupra recursului de față;
Împotriva acestei sentințe a declarat recurs L.M..
312 alin. (1) C. proc. civ. raportat la art. 3021, admițând excepția invocată, Înalta Curte urmează a constata nul recursul formulat în cauză de recurenta L.M..
