The High Court of Cassation and Justice ordered the annulment of the appellant company’s appeal petition, thereby upholding the lower courts’ dismissal of the commercial action and their acceptance of the National Bank’s exception of lack of passive procedural standing. The dispute arose from a commercial lawsuit filed by a limited liability company against the central bank and a commercial bank, where the plaintiff challenged the appellate court’s rejection of its claims; however, the higher court found a fatal procedural defect rather than addressing the merits. The decisive legal basis was the mandatory requirement under Article 3021(1)(d) of the Civil Procedure Code that an appeal filed by a legal entity in its own name must bear the signature of its authorized representative, and the court ruled that the submission, which was signed only by a lawyer without a specific delegation for the appeal stage, was null and void.

Împotriva acestei decizii a declarat recurs reclamanta SC D.M.I. SRL Craiova.

Recurenta–reclamantă își subsumează criticile motivelor de modificare reglementate de art. 304 pct.
