The Supreme Court of Cassation and Justice dismissed as inadmissible the annulment petition filed by the appellant, upholding the finality of the lower court’s 2001 decision. The dispute concerned a challenge to an irrevocable civil judgment, where the appellant sought to overturn the decision not on procedural or legal grounds, but because she was dissatisfied with the outcome and wished to re-adjudicate the merits against the opposing party, claiming civil damages in a related matter. The court determined that the grounds for appeal did not fit within the exhaustive list of statutory exceptions for annulment, specifically citing Articles 317 and 318 of the Civil Procedure Code, which restrict this extraordinary remedy to defects in the summons procedure, violations of public order regarding jurisdiction, material errors, or the failure to investigate specific grounds in a prior appeal; consequently, the appellant's subjective dissatisfaction and desire for a retrial were deemed insufficient to meet these narrow legal criteria.
