Commercial claim perempted on both appeals for one-year inactivity; lower court ruling final.
Legislator summary
AI generatedThe High Court of Cassation and Justice ruled the appeals filed by both parties against the Court of Appeal Pitești’s decision no. 642/A-C of 30 November 2000 as perempted (lapsed), thereby upholding the lower court’s decision as final and irrevocable. The dispute involved a commercial matter in which the appellant company and the respondent company each challenged the appellate ruling; however, after the proceedings were suspended on 16 October 2002 pursuant to Article 242(2) of the Civil Procedure Code, the case remained inactive for over the statutory period due to the parties’ fault. The court applied Articles 248 and 252 of the Civil Procedure Code, which mandate automatic peremption of any claim left pending for one year in civil matters (or six months in commercial matters) and allow the court to find peremption either on request or ex officio.
