The High Court of Cassation and Justice took formal note of the withdrawal of the appeal filed by the defendant against the July 14, 2011 ruling of the Constanța Court of Appeal, which had maintained the defendants' preventive arrest for 60 days and rejected requests to replace it. As a result, the contested ruling remains in force and the withdrawing defendant was ordered to pay 100 lei in judicial costs to the state, of which 50 lei (court-appointed counsel fee) is to be advanced from the Ministry of Justice fund. The appeal was resolved solely on procedural grounds under Article 192(2) of the Criminal Procedure Code, since the appellant voluntarily withdrew his recourse, with no examination of the merits of the preventive detention measure.

Asupra recursului penal de față;

160/b C. proc. pen. s-a menținut starea de arest a inculpaților F.D.I., F.G.C., D.G.

192 alin. (2) C. proc. pen.
