Failure to deposit security with competent appellate court bars suspension of judgment enforcement
Legislator summary
AI generatedThe High Court of Cassation and Justice dismissed the appellant-defendant's appeal as unfounded, thereby upholding the Court of Appeal's prior refusal to suspend the enforcement of the lower court's commercial sentence. The dispute arose from the defendant's request to suspend the enforcement of a judgment against the plaintiff for unpaid debts, a motion the trial court had denied; the appellate court initially rejected the suspension request because the defendant failed to deposit the required security directly with the appellate court, having instead paid the bank order to the lower court and submitting only a photocopy of the payment order. The decisive legal basis was Article 723(1) of the Code of Civil Procedure, which mandates that the security sum for suspension must be deposited at the disposal of the specific court competent to rule on the request (the appellate court in this instance), rendering the defendant's payment to the trial court and the submission of a copy rather than the original title of value a violation of procedural law.

Asupra recursului de față;
