The High Court of Cassation and Justice annulled as untimely filed (netimbrat) the appeal (recurs) brought by the defendant, thereby leaving in force the lower court decisions that had partially granted the plaintiff's claim and ordered the defendant to pay a debt and damages. The underlying dispute involved a commercial claim for payment arising from the division of a state-owned entity, with the defendant appealing an appellate decision that upheld the trial court's partial award. The appeal was dismissed solely on procedural grounds: the defendant failed to pay the required stamp duty and judicial stamp, despite being notified, in violation of Article 20(3) of Law 146/1997 and Article 9 of Government Ordinance 35/1995, which mandate stamping of legal filings.

A. S.A., pârâta S.C. U.C.
