Restriction of foreign travel rights dismissed as lacking interest due to existing severe suspension; appeal annulled for failure to pay judicial stamp tax
Legislator summary
AI generatedThe High Court of Cassation and Justice annulled the appellant's appeal for lack of judicial stamp, thereby rendering the prior appellate decision final and irrevocable, which had rejected the Ministry of Interior's claim. The dispute arose from the Ministry's challenge to a trial court's refusal to restrict a defendant's right to free circulation in France for three years, a restriction deemed lacking in interest by the appellate court because the defendant was already subject to a more severe suspension of foreign travel rights until 2015. Applying Article 312(1) of the Code of Civil Procedure in conjunction with specific provisions of Law No. 146/1997 and Government Ordinance No. 32/1995, the court determined that the appellant's failure to pay the required judicial stamp tax constituted a procedural defect mandating the annulment of the appeal, leaving the underlying civil judgment in force.

20 alin. (39 din Legea nr. 146/1997 și art. 9 alin. (2) din O.G. nr. 32/1995, recursul va fi anulat ca netimbrat.
