Recourse inadmissible against irrevocable appellate decision declaring peremption
Legislator summary
AI generatedThe High Court of Cassation and Justice dismissed as inadmissible the appeal filed by the claimant against the Court of Appeal's decision, thereby rendering the lower court's ruling irrevocable. The dispute concerned the procedural status of a prior civil case where the Court of Appeal had declared the claimant's appeal time-barred under Article 248 of the Code of Civil Procedure, citing a lapse of more than one year without procedural activity during the suspension of judgment. The Supreme Court determined that the contested decision was irrevocable under Article 377(2)(4) of the Code of Civil Procedure, which defines certain rulings, including those issued in the resolution of an appeal, as not subject to further appeal. Relying on the principles of legality and uniqueness of the appellate system, the Court held that no further appeal could be exercised against an irrevocable judgment, as the legal avenues for challenge had been exhausted, thus mandating the rejection of the new appeal.

Împotriva acestei decizii a declarat recurs reclamanta M.G..
