Perempted appeal leaves annulment intact, defendants liable on commercial damages award
Legislator summary
AI generatedThe court held the appeal (recurs) filed by the defendant to be perimted (perimat) and thus irrevocable, meaning the prior ruling—the appellate court’s annulment of the defendants’ appeal as unstamped, which left the trial court’s judgment in force—remains effective in the plaintiff’s favor. The case arose from a commercial damages claim for 16,245,945 lei plus legal interest and costs, in which the trial court had ordered the defendants to pay jointly and severally; the defendants’ appeal was annulled for failure to pay the stamp fee, and the defendant then appealed that annulment decision. The Supreme Court applied Article 248 of the Romanian Code of Civil Procedure, which provides that any claim is perimted by operation of law if it remains inactive for six months in commercial matters due to the party’s fault, and Article 252, allowing the court to find peremption ex officio; because the appeal had been suspended for over six months owing to the parties’ passivity, the court declared it perimted.

Asupra recursului de față;
A. S.A. Craiova, împotriva pârâților C.C.A., B.V.
